2. General Provisions
This document is a public offer (hereinafter referred to as the "Agreement") by the Seller to conclude an online sales agreement for artworks and art prints (hereinafter referred to as the "Products") on the terms set forth below. By placing an Order on the website, you (hereinafter referred to as the "Customer") fully and unconditionally accept all terms of this Agreement.
3. Products
All Products are original creations or limited edition prints by the artist. Due to the nature of art and differences in monitor calibration, colors may slightly vary from the images on the website.
4. Prices, Taxes, and Payment
4.1. All prices on the website are indicated in US Dollars (USD).
4.2. Tax Information: The Seller, Individual Entrepreneur Ekaterina Shchukina (ID: 326120996), operates under the simplified tax system of Georgia and is not a registered payer of Value Added Tax (VAT) in accordance with the Tax Code of Georgia (Article 100(1)). Therefore, prices are indicated excluding VAT and no VAT will be added to the invoice or the final price.
4.3. Payment is processed securely through third-party payment service providers, including UniPAY and PayPal. The website does not store or process your full payment card details.
4.4. The security of the payment transaction is ensured entirely by the respective payment service provider in accordance with their rules and PCI DSS standards. The Seller is not responsible for any technical failures, delays, or data breaches that occur during the payment processing on the side of the payment service provider.
4.5. The Order is considered confirmed only after successful payment authorization.
5. Ordering and Fulfillment
5.1. The Seller reserves the right to cancel an Order before shipment in exceptional cases (e.g., unforeseen unavailability or damage of the Product). In such a case, a full refund will be issued within 14 business days.
5.2. Orders are processed within 1–3 business days after payment confirmation.
6. Shipping and Delivery
6.1. All Products are shipped from Georgia.
6.2. Shipping costs, available methods, and estimated delivery times are calculated and displayed at the checkout stage.
6.3. Delivery times are approximate and may vary due to factors beyond the Seller's control (customs clearance, postal delays, etc.).
6.4. Customs duties, taxes, or import fees imposed by the destination country are the sole responsibility of the Customer.
7. Returns, Refunds, and Damaged Goods
7.1. Original Artworks: Due to their unique nature, all sales of original artworks are final. They are non-refundable and non-returnable.
7.2. Art Prints: Returns or replacements are accepted only if the item arrives damaged or is fundamentally not as described.
7.3. To report a damaged item, the Customer must contact the Seller via email within 7 calendar days of receiving the parcel, providing clear photographic evidence.
7.4. If a refund is approved, it will be processed to the original payment method (bank card or PayPal account) used for the purchase. The refund will be initiated by the Seller within 14 business days from the date of approval. The time required for the funds to appear in the Customer's account depends on the policies of their bank or payment service provider.
7.5. Shipping costs are non-refundable, unless the return/replacement is due to the Seller's error or confirmed damage during transit by the carrier.
7.6. Lost Shipments: If the tracking information confirms that a shipment is lost, the Seller will, at the Customer's choice, offer a replacement or a full refund.
8. Intellectual Property Rights
All copyrights and intellectual property rights for the artworks and their images remain the exclusive property of the Artist (Seller). The purchase of a physical Product grants ownership of that physical item only. It does not grant any license or right to reproduce, distribute, or commercially exploit the artwork's image without the Artist's prior written consent. The Customer may share images of the purchased Product for personal, non-commercial use on social media with mandatory attribution to the Artist (© Ekaterina Shchukina).
9. Force Majeure
The Seller is not liable for delays or failures in performance resulting from circumstances beyond reasonable control (force majeure), including natural disasters, wars, strikes, interruptions in power or communication networks, or actions of governmental authorities.
10. Governing Law and Dispute Resolution
10.1. This Agreement is governed by and construed in accordance with the laws of Georgia.
10.2. Any disputes shall be resolved through preliminary negotiations via email. If a mutual agreement is not reached, disputes shall be referred to the competent courts of Georgia.
